TERMS AND CONDITIONS

  1. Definitions
    For the purpose of this document -

    1. Throughout the site, the terms “Debs”, “I”, “me”, “my”, “we”, “us” and “my” refer to Debs Saunders.

    2. The term “Website” refers to Debs Saunders’ website, currently located at www.debsaundersartwork.com

  2. Services and Use

    1. Debs Saunders’ services include, but are not limited to:

      1. Commissioned portraits of pets

      2. Commissioned paintings of Debs Saunders’ original designs

      3. Limited and unlimited series of prints, based on Debs Saunders’ original designs

    2. Debs Saunders' services are open to any natural person of full age (or minor with written parental consent) or legal entity.

    3. Debs Saunders refuses any work contrary to Israeli legislation.

    4. As digital images’ appearance may vary when viewed on different displays, the images on the Website depicting Debs Saunders’ products may vary slightly from the physical appearance of the products.

    5. You may not use the Website in any way that is, or may be, damaging to the Website or that might impact user access to it.

    6. You are responsible to verify that all the details that you provide to Debs Saunders are true and accurate.

    7. Debs Saunders is not liable for 3rd party services (such as, but not limited to, Postal and other delivery services and payment clearing services).

  3. Rights and Ownership

    1. Debs Saunders retains all rights to all her artwork, including, but not limited to, images displayed on the Website, commissioned artwork and any reproduction of Debs’ work, unless explicitly expressed by Debs in writing.

    2. You may not reproduce any of the artwork and images displayed on the Website without written permission from Debs Saunders.

    3. If you purchased artwork from Debs Saunders, you have the right to display it in your home or business. However, the artwork may not be resold or used for reproduction in any way without written permission given by Debs Saunders.

    4. You may share links to the Website on social media. However, you may not publish any material from the Website in any other media without written permission given by Debs Saunders.

    5. When placing an order for a commissioned portrait, you may be asked to provide an image for reference. You own and hold copyright on the reference image. However, unless explicitly requested otherwise by you, Debs Saunders retains the right to use the reference image on the Website and on social media, only in the context of Debs’ artwork. As mentioned above, Debs will never reproduce or sell the reference image.

  4. Contacting Debs Saunders

    1. Debs Saunders may be contacted via any of the following methods:

      1. Contact Forms on the Website
        You may fill a contact form, either in the “Contact” section or in the “Commissioning a Painting” page on the Website.

      2. Email
        You may send Debs Saunders an email at debsaundersartworks@gmail.com

    2. Debs Saunders will respond within 5 business days.

  5. Payments
    All payments can be made securely via PayPal, using services provided by Wix Shops.

  6. Commissions

    1. Debs Saunders reserves the right to take on or turn down commissions as she sees fit. A commission deal is not considered agreed upon until a quote was sent by Debs and the down-payment was placed by the customer.

    2. Ordering a Commission
      To begin the process of commissioning a product, you may contact Debs Saunders (as described in Section 4 of this document). Debs Saunders will respond within 5 business days and provide all the information and details necessary to move forward. In the case of commissioning a pet portrait these details usually include the following:

      1. Source Image
        Debs Saunders will require a high quality photograph of your pet. You may send more than one image. You may be asked to provide more images if necessary.

      2. Medium and Size

        1. Debs Saunders usually uses watercolors and pencils on watercolor paper.

        2. Debs Saunders works on A4 and A5 size paper. If you require a different size, you must make note of the size you want when sending all the details and before receiving the price quote for the commission.

      3. Deadline

        1. Debs Saunders requires a lead time of at least 6 week to create a commissioned painting. This does not include shipping time. If the deadline date for the commission is in less than 6 weeks of placing the order, Debs may choose to not accept the order, or to add an additional cost.

        2. Debs Saunders aims to have the painting ready within 6 weeks of the order being placed.

      4. Framing
        If framing was requested upon placing an order, the following apply:

        1. Debs Saunders does not frame the paintings herself. Framing is done by a third party service provider who customizes the frames by order. Debs Saunders is not affiliated with said party in any way.

        2. As the framing is performed by a third party, Debs Saunders cannot be responsible for the time it takes. From past experience, framing usually adds approximately a week to the delivery time.

        3. As the frame and the special packaging necessary to protect it will add substantial weight to the finished product, shipping costs might be added to the final price.

        4. Debs Saunders does not cover the costs of reframing a damaged product as framed paintings are more susceptible to damage during shipping. 

      5. Price Quote
        Once Debs Saunders has collected all of the necessary details for your order, she will send you a quote via email.

        1. The quote will include a request for a down-payment of 30% of the final price of your order.

        2. This quote will be valid for 7 days and the order will not be confirmed until the down-payment has been received.

        3. If you still want to place the order after the quote has expired, you may contact Debs Saunders and she will send you a new quote. Keep in mind that there may be a price difference between the two quotes.

        4. The price of the portrait depends on the details of your order. Generally, the prices are as follows (These price approximations do not include framing and shipping):

          1. A5 portraits will cost approximately $250

          2. A4 portraits will cost approximately $350 

      6. Final Payment and Shipping

        1. Upon completion of the painting, you will be notified by Debs Saunders and receive a request for the remaining payment.

        2. Once Debs Saunders receives the remaining payment, your painting will be delivered via post.

        3. All portraits are packed carefully to help prevent damage, and posted with a tracking number provided by the shipping party (for example the Post Office). All tracking details will be sent to you by email upon delivery.

  7. Refund Policy

    1. Damage During Shipping

      1. Debs Saunders ensures that the artwork is packaged to a very high standard. However in the unfortunate event of the product being damaged during shipping, kindly contact Debs (as described in Section 4 of this document) within 3 days of receiving the delivery and inform her of the damage. You will be requested to provide her with as many details as possible and a photograph of said damage.

      2. Debs may ask for the damaged product to be shipped back to a provided address for inspection, at which time the conditions for replacing the product will be determined. Shipping costs will be covered by Debs Saunders.

      3. If replacing a damaged commissioned product with a new one involves recreating it, you may be asked to cover some of the expenses. In that case, you will receive a quote for the amount before the process begins. You will then be able to decide whether to continue with the process or to receive a refund for the damaged product. The process of recreating a damaged product will only begin upon receiving said payment.

    2. Order Cancellation
      If, for any reason, you need to cancel your order of a commissioned product, you must contact Debs Saunders (as described in Section 4 of this document), no later than 5 business days after the order was placed, unless otherwise stated in the price quote and agreed upon receiving the down-payment.

    3. Down-payment Refund
      In any case, you will not be refunded for the down-payment

  8. Privacy

    1. Any personal details that you provide to Debs Saunders (your name, contact details, and payment details) will be kept in confidence and will only be used by Debs Saunders to communicate with you, and for the purposes of charging and shipping your order.

    2. Debs Saunders will not sell your personal information to third parties.

    3. When you order a product, Debs Saunders collects the personal information you provide, such as your name, address, email address and, in the case of commissioning a pet portrait, photographs of your pet, solely for the purpose of painting the portrait, communicating with you, and shipping the item to your address.

    4. When you provide your personal information to complete a transaction, place an order, arrange for a delivery or return a purchase, Debs Saunders requires that you give consent to collect the information and for that specific reason only.

    5. Deb Saunders’ store is based on Wix Shops. They provide the online e-commerce platform that allows Debs Saunders to sell the products and services provided to you. For more information, you may want to read Wix’s Terms of Service and/or Privacy Statements.

    6. Third Party Services
      Certain third-party service providers, such as PayPal, have their own privacy policies in respect to the information Debs Saunders is required to provide to them for your purchase-related transactions.
      For these providers, Debs Saunders recommends that you read their privacy policies so that you can understand the manner in which these providers will handle your personal information.
